Class E Permitted Development Criteria for Surrey Outbuildings

Under the Town and Country Planning (General Permitted Development) Order, garden rooms, detached garages, and offices fall under Class E. This legislation grants homeowners the right to build without formal planning permission, provided the project aligns with the national structural criteria outlined below.

Maximum Height Enforcements (Class E)

The maximum height of a Surrey garden room is strictly governed by its distance from your property boundary lines and the type of roof configuration.

Footprint, Positioning, and Curtilage Allocations

The 50% Curtilage Restriction.

You cannot cover more than half the total area of your garden with outbuildings or extensions. The "original garden size" refers to the property footprint as it stood in 1948 (or when it was built, if newer).

Front Elevation Constraints.

No outbuilding can sit on land situated forward of the principal elevation (the front wall) of your original house. Garden rooms must strictly occupy side or rear garden spaces.

Verandas, Balconies, and Raised Platforms.

Permitted development strictly prohibits balconies, raised platforms, or verandas higher than 300mm. If your garden has a slope and requires a raised deck platform to level the garden room, full planning permission will likely be triggered if the platform exceeds 30cm off the natural ground level.


Surrey Green Belt & Conservation Area Exceptions

Surrey contains a high density of protected land categories. If your home falls within an Area of Outstanding Natural Beauty (AONB), a Conservation Area, or the Metropolitan Green Belt, standard national rights are heavily modified:


  • The 10-Metre Boundary Rule: On designated land (AONB/National Parks), any outbuilding situated more than 20 metres from the house must have a total footprint under 10 square metres to retain Permitted Development rights.


  • Side of House Restrictions: In Conservation Areas, outbuildings are not permitted on land situated between the side elevation of the house and the property boundary.
